1. Acceptance of Terms
By downloading, installing, or using the Sound Graffiti mobile application, you agree to these Terms of Service. If you do not agree, you must immediately delete the application and cease accessing our servers.
2. User-Generated Content (UGC) Zero-Tolerance Policy
Sound Graffiti allows users to post audio files ("Whispers") to physical locations. We operate a strict, zero-tolerance policy against abusive content to maintain a safe grid.
- No Hate Speech: Content promoting violence or hatred against individuals or groups based on race, religion, gender, or orientation will result in an instant, permanent ban.
- No Harassment: Do not use the spatial grid to stalk, dox, or harass individuals.
- No Illegal Content: Posting illegal material or using the platform for illicit trade is strictly prohibited.
- Enforcement: Users can flag content. Our Admin team reviews reports within 24 hours. Violating content is purged from the database, and the offending user's account is permanently wiped.
3. Intellectual Property
You retain ownership of the audio you record. However, by uploading a Whisper to Sound Graffiti, you grant us a worldwide, royalty-free license to host, distribute, and broadcast that audio to other users via our platform.
You agree not to upload copyrighted music or material that you do not own the rights to broadcast.
4. Network Termination
We reserve the right to suspend or terminate your access to the Sound Graffiti network at any time, for any reason, without prior notice. Common reasons for termination include violation of our UGC rules or attempts to reverse-engineer our spatial mapping algorithms.
5. Limitation of Liability
Sound Graffiti is a location-based app. You agree to use it safely. We are not liable for any injuries, accidents, or damages that occur while you are exploring the physical world using our app. Always remain aware of your physical surroundings. Do not trespass on private property to reach a Whisper.
6. Dispute Resolution
Any disputes arising from these terms will be resolved through binding arbitration in the jurisdiction of our corporate headquarters, rather than in court.
